These Terms of Service ("Terms") govern your access to and use of the AFLOAT platform, including our mobile application and website, operated by AFLOAT Wellness Ltd. ("AFLOAT", "we", "us", or "our"). By creating an account or using AFLOAT, you agree to be bound by these Terms. Please read them carefully.
1. About AFLOAT
AFLOAT is a mental wellness platform designed exclusively for maritime professionals. Our services include mood tracking, guided mindfulness exercises, peer support resources, sleep tools, and access to mental health content tailored to the demands of life at sea.
AFLOAT is a wellness support tool and is not a medical service, clinical treatment, or substitute for professional mental health care. If you are experiencing a mental health crisis, please contact your ship's medical officer or an emergency support service immediately.
2. Eligibility
To use AFLOAT, you must:
- Be at least 18 years of age.
- Be a maritime professional or have a legitimate connection to the maritime industry.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the service under applicable law.
By using AFLOAT, you confirm that you meet these eligibility requirements. We reserve the right to suspend or terminate accounts that do not comply.
3. Your Account
When you register for AFLOAT, you agree to provide accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately at support@afloatwellness.com if you suspect unauthorised access.
You may not share your account with others or create multiple accounts for the same individual. Accounts are personal and non-transferable.
4. Acceptable Use
You agree to use AFLOAT only for its intended purpose — supporting your personal mental wellness. You must not:
- Use the platform for any unlawful, harmful, or fraudulent purpose.
- Upload or share content that is abusive, threatening, discriminatory, or harassing.
- Attempt to reverse-engineer, decompile, or extract source code from the app.
- Use automated tools, bots, or scripts to access or scrape the platform.
- Interfere with or disrupt the integrity or performance of the service.
- Impersonate any person or entity, or misrepresent your affiliation with any organisation.
- Share another user's personal or wellness data without their explicit consent.
Violation of these terms may result in immediate suspension or termination of your account without notice.
5. Wellness Content and Limitations
AFLOAT provides general mental wellness content, tools, and resources. This content is intended for informational and self-support purposes only. It does not constitute medical advice, diagnosis, or treatment.
- Always seek the advice of a qualified healthcare professional for any mental health concerns.
- Do not disregard professional medical advice or delay seeking it because of something you have read or experienced on AFLOAT.
- In a medical emergency or mental health crisis at sea, contact your ship's medical officer, the ITF Seafarers' Helpline, or local emergency services immediately.
AFLOAT is not liable for any decisions made based on content within the platform.
6. Intellectual Property
All content, design, code, trademarks, and materials within the AFLOAT platform are the exclusive property of AFLOAT Wellness Ltd. or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use AFLOAT for your personal, non-commercial wellness purposes. You may not reproduce, distribute, modify, or create derivative works from any part of the platform without our prior written consent.
7. User-Generated Content
Content you create within AFLOAT — including journal entries, mood logs, and personal reflections — remains yours. You retain full ownership of your personal wellness data.
By submitting any content to community or shared features (where available), you grant AFLOAT a limited licence to display that content within the platform for the purpose of delivering the service. We will never share your personal wellness content publicly or with third parties without your explicit consent.
8. Subscription and Payments
AFLOAT may offer free and premium subscription tiers. Where a paid subscription is available:
- Subscription fees are billed in advance on a monthly or annual basis as selected at sign-up.
- All fees are stated in GBP (or your local currency equivalent) and are inclusive of applicable taxes.
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
- Refunds are not provided for partial billing periods, except where required by applicable consumer law.
- We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers.
9. Offline Functionality
AFLOAT is designed with seafarers in mind and supports offline use. Certain features — including mood tracking, journaling, and guided exercises — are available without an internet connection and will sync when connectivity is restored.
We make no guarantee of uninterrupted service and are not responsible for any loss of data resulting from connectivity issues, device failure, or circumstances beyond our control.
10. Privacy
Your use of AFLOAT is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting your personal and wellness data with the highest standards of care and confidentiality.
11. Termination
You may close your account at any time through the app settings or by contacting us at support@afloatwellness.com. Upon closure, your personal data will be deleted in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your account at our discretion if you breach these Terms, engage in conduct harmful to other users or the platform, or if we are required to do so by law. Where possible, we will provide notice before taking such action.
12. Disclaimers and Limitation of Liability
AFLOAT is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, AFLOAT Wellness Ltd. disclaims all warranties, including fitness for a particular purpose and non-infringement.
In no event shall AFLOAT Wellness Ltd. be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of AFLOAT shall not exceed the amount you paid to us in the 12 months preceding the claim.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of AFLOAT shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are based outside the UK, local mandatory consumer protection laws may also apply and are not affected by this clause.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via the app or by email at least 14 days before the changes take effect. Continued use of AFLOAT after the effective date constitutes your acceptance of the revised Terms.
The "Last updated" date at the top of this page will always reflect the most recent revision.
